Terms of Service

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYVRP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OF INFORMATION, AND AVAILABILITY OF THE PLATFORM.

MYVRP DOES NOT GUARANTEE THAT THE PLATFORM WILL BE ERROR-FREE, AVAILABLE AT ALL TIMES, OR THAT USERS WILL RECEIVE INQUIRIES, BOOKINGS, OR GENERATE REVENUE FROM LISTINGS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYVRP SHALL NOT BE LIABLE FOR PROPERTY DAMAGE, PERSONAL INJURY, FRAUD, THEFT, MISREPRESENTATIONS BY HOSTS OR GUESTS, LOST PROFITS, LOST BUSINESS OPPORTUNITIES, OR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

IN NO EVENT SHALL MYVRP'S TOTAL LIABILITY EXCEED THE AMOUNT PAID TO MYVRP BY THE USER DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IF NO FEES WERE PAID, MYVRP'S LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Any dispute arising from these Terms or use of the Platform shall first be attempted to be resolved through good-faith negotiations.

If a dispute cannot be resolved informally, it shall be submitted to binding arbitration in San Diego County, California, except where prohibited by law.

YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION AGAINST MYVRP LLC.

Certain features of the Platform may be offered through paid subscription plans ("Subscriptions"), as listed on myvrp.com/pricing.

By purchasing a Subscription, you agree to pay all fees associated with your selected plan. Subscription fees are charged in U.S. Dollars (USD) unless otherwise specified.

MyVRP reserves the right to modify pricing, features, benefits, or subscription plans at any time. Any changes will apply prospectively and will not affect previously paid subscription periods.

MyVRP does not guarantee inquiries, leads, reservations, occupancy, rental income, business growth, or any particular results from use of the Platform. Any examples, testimonials, case studies, or marketing materials are provided for illustrative purposes only.

Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date.

By purchasing a Subscription, you authorize MyVRP LLC and its payment processors to charge your selected payment method for recurring subscription fees.

You may cancel your Subscription at any time through your account settings or by contacting MyVRP. Cancellation will take effect at the end of the current billing cycle. Unless otherwise required by law, no partial refunds will be issued for unused portions of a subscription term.

Subscription payments are processed through independent third-party payment providers. MyVRP LLC does not store complete credit card or payment account information.

You agree to provide accurate, current, and complete payment information. If payment cannot be successfully processed, MyVRP may suspend or terminate access to paid features until payment is received.

For Hosts who choose to enable guest payment collection, MyVRP integrates with Stripe Connect, which allows a Host to receive payments directly into the Host's own Stripe-connected account. MyVRP is not a party to those payment transactions, does not hold or take custody of guest funds at any time, and does not guarantee the availability, accuracy, or successful processing of any payment, payment request, or refund initiated through the Platform. Use of Stripe Connect is also subject to Stripe's own terms of service and, where applicable, "Know Your Customer" and underwriting requirements imposed by Stripe.

Guest payments are charged in the currency of the property, which a Host selects when creating the property and which may be U.S. dollars (USD), Mexican pesos (MXN), or Canadian dollars (CAD). The countries in which a Host can connect a Stripe account through the Platform are determined by MyVRP and by Stripe's own availability and may change. Fees, currency conversion, and payout timing applied by Stripe, card issuers, or banks are outside MyVRP's control.

MyVRP LLC shall not be responsible for errors, outages, processing delays, declined payments, failed payouts, chargebacks, disputes, or other issues caused by Stripe or any other third-party payment provider.

If you provide a mobile phone number and opt in to receive text messages (SMS) from MyVRP or a Host through the Platform — whether when creating an account, updating your account settings, or submitting a property inquiry or booking request — you agree to the following terms.

Consent

By checking the applicable SMS consent checkbox — whether when creating a MyVRP account, updating your account settings, or submitting an inquiry or booking request through a property page — you expressly consent to receive automated text messages from MyVRP or a Host. For Hosts, these messages may include account notifications and platform updates. For guests, these messages may include responses to inquiries, booking confirmations, check-in and check-out instructions, and stay-related communications. Consent to receive text messages is not required as a condition of using the Platform, creating an account, or booking any property.

Message Frequency and Rates

Message frequency varies based on your reservation activity. Message and data rates may apply depending on your mobile carrier and plan. MyVRP LLC is not responsible for any charges imposed by your mobile carrier.

Opting Out

You may opt out of receiving text messages at any time by replying STOP to any message you receive. For assistance, reply HELP or contact us using the information in Section 30.

Supported mobile carriers are not liable for delayed or undelivered messages. MyVRP LLC reserves the right to change or discontinue SMS communications at any time.

Usage Limits

MyVRP LLC reserves the right to limit, throttle, or temporarily suspend the number of SMS or WhatsApp messages a Host may send through the Platform, based on overall platform demand, cost, deliverability, or to prevent misuse, spam, or abuse. See Section 31 ("Usage Limits and Fair Use") for additional terms.

Except where required by applicable law, all subscription fees are non-refundable.

No refunds shall be provided for partial subscription periods, failure to use the Platform, lack of inquiries or bookings, user dissatisfaction after activation, suspension resulting from violations of these Terms, or changes to Platform features or pricing.

MyVRP LLC may, at its sole discretion, issue refunds or credits on a case-by-case basis. Any refund issued in one instance shall not obligate MyVRP LLC to provide refunds in future situations.

MyVRP LLC may offer free trials, discounts, promotional pricing, beta access, or limited-time offers. Unless otherwise stated, once a free trial period ends, the applicable subscription fee will be charged automatically unless canceled before the end of the trial period.

MyVRP LLC reserves the right to modify, suspend, discontinue, or terminate any promotional offer at any time without liability. Promotional offers may not be combined with other discounts unless expressly stated by MyVRP LLC.

MyVRP may provide artificial intelligence ("AI") tools, chatbots, automated assistants, search features, recommendation systems, or other automated technologies to assist users.

AI-generated responses are provided for informational and convenience purposes only. AI-generated information may be inaccurate, incomplete, outdated, misleading, or unavailable.

Users should independently verify important information with the Host before making travel or booking decisions, including property details, amenities, availability, pricing, house rules, check-in instructions, and cancellation policies.

MyVRP LLC shall not be liable for any losses, damages, expenses, booking decisions, travel decisions, misunderstandings, or disputes arising from reliance on AI-generated responses, recommendations, summaries, or automated communications.

MyVRP LLC reserves the right to limit, throttle, or temporarily suspend the number of AI-generated replies available to a Host's account or properties, based on overall platform demand, cost, or to prevent misuse or abuse of AI features. See Section 31 ("Usage Limits and Fair Use") for additional terms.

The Platform is under continuous, active development. MyVRP may add, modify, suspend, limit, or discontinue any feature, tool, or functionality at any time, with or without notice, including features described in these Terms, in marketing materials, or in any user guide or Help Center.

New and existing features — including the CRM, guest messaging, add-ons and upsells, team accounts, analytics and reporting, and payment collection tools — may from time to time contain bugs, errors, defects, downtime, or unexpected behavior, and may not function as intended at all times.

BY USING THE PLATFORM, YOU ACKNOWLEDGE THAT IT IS PROVIDED ON AN EVOLVING, "AS IS" AND "AS AVAILABLE" BASIS, THAT ERRORS AND INTERRUPTIONS MAY OCCUR, AND THAT YOU USE THE PLATFORM — INCLUDING ANY NEW, BETA, OR RECENTLY RELEASED FEATURE — ENTIRELY AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYVRP SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, OR DISRUPTION ARISING FROM CHANGES TO THE PLATFORM, TEMPORARY OR PERMANENT UNAVAILABILITY OF ANY FEATURE, OR ERRORS OR DEFECTS IN THE PLATFORM'S OPERATION. This section supplements, and does not limit, the disclaimers in Section 10 and the limitations in Section 11.

Certain Platform features — including, without limitation, AI-generated replies (through the public property-page assistant and the guest portal assistant) and SMS/WhatsApp messaging (whether sent individually or in bulk) — rely on third-party services and infrastructure that carry real, variable costs and capacity constraints.

MyVRP LLC reserves the right, at its sole discretion and without prior notice, to:

• Set, adjust, raise, lower, or remove limits on the volume of AI replies, SMS messages, WhatsApp messages, emails, or other automated communications available to any Host's account, on an hourly, daily, monthly, or other periodic basis;
• Apply different limits to different accounts based on subscription tier, usage history, platform demand, cost, or any other factor MyVRP LLC deems relevant;
• Temporarily suspend or block access to any such feature for an account that exceeds an applicable limit, until the limit resets, is increased, or is otherwise adjusted by MyVRP LLC;
• Suspend, restrict, or terminate a Host's access to any such feature, or to the Platform generally, where MyVRP LLC reasonably believes the feature is being misused, abused, or used in a manner inconsistent with its intended purpose (including, without limitation, sending unsolicited or unwanted messages, attempting to circumvent any limit, or using AI features for purposes unrelated to legitimate guest communication); and
• Modify, suspend, or discontinue any such feature entirely, in accordance with Section 29.

MyVRP LLC does not guarantee any minimum number of AI replies, SMS messages, or other automated communications will be available to a Host's account at any given time, regardless of subscription tier or any number referenced in marketing materials, the Help Center, or any user guide.

A Host remains solely responsible for ensuring guests have an alternative way to reach them (such as a phone number or email address) in the event an automated feature is temporarily limited or unavailable. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYVRP LLC SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, MISSED BOOKING, OR GUEST DISSATISFACTION ARISING FROM A MESSAGE, REPLY, OR COMMUNICATION THAT WAS DELAYED, NOT SENT, OR NOT GENERATED BECAUSE AN APPLICABLE LIMIT WAS REACHED. This section supplements, and does not limit, Sections 10, 11, and 29.
